Welcome to Spartify (“Spartify”, “we”, “us”, or “our”), accessible at www.spartify.in (the “Website”). Spartify is an online store for handmade art and craft products — including custom nameplates, paintings, sculpture art, wooden home decor, hand-painted handbags, Indian traditional art (Gond, Mandala, Lippan/Jharokha), and DIY kits — and we also organise creative art workshops and competitions.
These Terms and Conditions (“Terms”) govern your access to and use of the Website, and your purchase of products or participation in workshops/competitions offered by us. By accessing the Website, creating an account, placing an order, or registering for a workshop, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
These Terms should be read together with our Privacy Policy and Refund and Returns Policy, both available on the Website, which are incorporated herein by reference.
1. About Us

2. Eligibility
By using this Website, you represent that you are at least 18 years of age, or are accessing the Website under the supervision of a parent or legal guardian. If you are registering for a workshop on behalf of a minor, you confirm that you are the parent/guardian or have obtained appropriate consent.
3. Account Registration
You may need to create an account to place orders or register for workshops. You agree to:
Provide accurate, current, and complete information at the time of registration;
Maintain the confidentiality of your account login credentials;
Be responsible for all activities that occur under your account;
Notify us immediately of any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that provide false information or are used in violation of these Terms.
4. Products and Descriptions
All products listed on the Website are handmade or hand-finished. We make reasonable efforts to display product images, colours, and descriptions as accurately as possible. However:
Since many products are handcrafted, slight variations in colour, texture, size, or finish compared to the images shown may occur, and such variation does not constitute a defect;
Product images are for illustrative purposes; actual product packaging, size, or accessories may vary;
We reserve the right to modify, discontinue, or update any product or its description at any time without prior notice.
5. Orders, Customization, and Confirmation
5.1 Placing an Order: When you place an order on the Website, it constitutes an offer to purchase the product(s). An order is confirmed only once we accept it, which may be communicated via email, SMS, or WhatsApp.
5.2 Customization: For customized products (such as nameplates, personalised paintings, or made-to-order items), our artist/team will contact you after the order is placed to confirm design details, text, colours, dimensions, or other specifications. Production will commence only after such details are finalised with you.
5.3 No Advance Payment: Where advertised, certain orders may be accepted without advance payment; however, we reserve the right to require full or partial advance payment for select products, bulk orders, or highly customized items, which will be communicated to you before order confirmation.
5.4 Right to Refuse: We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, unavailability of materials, pricing errors, or inability to fulfil customization requests, in which case any payment already made will be refunded in accordance with our Refund and Returns Policy.
6. Pricing and Payment
All prices are listed in Indian Rupees (INR) and are inclusive/exclusive of applicable taxes as indicated on the product page.
We reserve the right to change prices at any time without prior notice; however, the price applicable to an order already confirmed will not change.
Payments may be made through the payment methods made available on the Website (online payment gateways, UPI, cash on delivery where applicable, etc.). We are not responsible for any failure of third-party payment gateways. In case payment method is not available in website, an artist/spartify team may contact you for relevant mode of payment. Please note the our contact details given above.
In case of any pricing or typographical error on the Website, we reserve the right to cancel the affected order and refund any amount paid.
7. Shipping and Delivery
We aim to ship and deliver products within the estimated timelines communicated at the time of order confirmation; however, timelines are indicative and not guaranteed, especially for customized/handmade items.
Delivery is currently available within India unless otherwise stated.
Risk in the products passes to you upon delivery. Please inspect the package on delivery and report any visible damage as per our Refund and Returns Policy.
Delays caused by courier partners, incorrect address details provided by you, or circumstances beyond our reasonable control (see “Force Majeure” below) are not our responsibility.
8. Cancellations, Returns, and Refunds
Cancellations, returns, exchanges, and refunds are governed by our separate Refund and Returns Policy, available at spartify.in/refund_returns/, which forms part of these Terms. Please note that customized/personalised products (such as nameplates with custom names, or bespoke paintings) may not be eligible for cancellation or return once production has commenced, except in cases of defect or damage, as detailed in that policy.
9. Workshops and Competitions
9.1 Registration: Registration for any art workshop or competition (such as painting workshops or competitions like the Mother’s Day Painting Competition) is subject to availability and, where applicable, payment of the registration fee.
9.2 Conduct: Participants are expected to conduct themselves respectfully during workshops. We reserve the right to remove any participant whose conduct is disruptive or inappropriate, without refund.
9.3 Changes: We reserve the right to reschedule, modify the format of, or cancel a workshop/competition due to insufficient registrations or circumstances beyond our control. In case of cancellation by us, registered participants will be offered a refund or rescheduled slot, at our discretion.
9.4 Media Consent: By participating in a workshop or competition, you consent to us photographing/recording the event and using such images or videos (which may feature you or your work) for promotional purposes on our Website and social media, unless you notify us in writing prior to the event that you do not consent.
9.5 Competition Entries: Submission of an entry to any competition implies that the entry is your own original work. We reserve the right to disqualify entries that are found to be plagiarised or in violation of competition rules published separately for that competition.
10. Intellectual Property
10.1 Our Content: All content on the Website — including the Spartify name, logo, product photographs, designs, text, graphics, and layout — is the property of Spartify or its licensors and is protected under applicable copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content on the Website without our prior written consent.
10.2 Artwork and Handmade Products: Original artworks, designs, and handmade products sold through the Website are created by our artists. Unless expressly agreed in writing (for example, in a commissioned/custom work agreement), purchase of a product transfers ownership of the physical item only, and does not transfer the underlying copyright or the right to reproduce, replicate, or commercially exploit the design or artwork.
10.3 User Content: If you submit content to us (such as photographs, text, or names for customization, or competition entries), you grant us a non-exclusive, royalty-free licence to use, reproduce, and display such content solely for the purpose of fulfilling your order, running the competition, or for promotional purposes as described in Clause 9.4.
11. User Conduct
You agree not to:
Use the Website for any unlawful purpose or in violation of these Terms;
Upload or transmit any content that is defamatory, obscene, infringing, or otherwise objectionable;
Attempt to gain unauthorised access to the Website, its servers, or any connected systems;
Use any automated means (bots, scrapers) to access or extract data from the Website without our consent;
Interfere with or disrupt the security or proper functioning of the Website.
12. Reviews and Testimonials
If you submit a product review or testimonial via the Website, you agree that it will be honest, based on your genuine experience, and free of unlawful, defamatory, or abusive content. We reserve the right to moderate, edit, or remove any review at our discretion.
13. Third-Party Links
The Website may contain links to third-party websites or platforms (such as Instagram, YouTube, WhatsApp, or payment gateways) for your convenience. We do not control and are not responsible for the content, policies, or practices of any third-party website. Your use of such third-party platforms is at your own risk and subject to their respective terms.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Spartify shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Website or purchase of products, including but not limited to loss of data, loss of profits, or business interruption. Our total liability arising out of any order shall not exceed the amount paid by you for that specific order.
Nothing in these Terms shall limit our liability for fraud, wilful misconduct, or any liability that cannot be excluded under applicable Indian law.
15. Force Majeure
We shall not be held responsible for any delay or failure to perform our obligations due to causes beyond our reasonable control, including but not limited to natural disasters, strikes, courier/logistics disruptions, government restrictions, internet or power outages, or other acts of God.
16. Indemnification
You agree to indemnify and hold Spartify, its owners, employees, and artists harmless from any claims, damages, liabilities, or expenses (including legal fees) arising out of your breach of these Terms, misuse of the Website, or violation of any third-party rights, including intellectual property rights, in content you submit to us.
17. Changes to These Terms
We may update or modify these Terms at any time to reflect changes in our practices or for legal/regulatory reasons. The updated Terms will be posted on this page with a revised “Last updated” date. Your continued use of the Website after such changes constitutes your acceptance of the revised Terms.
18. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Subject to any mandatory consumer-protection rights you may have (including the right to approach your local Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019), any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at [Insert City, e.g., Delhi], India.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed, and the remaining provisions shall continue in full force and effect.
